This Privacy Policy does not govern information shared with the Firm in the context of an attorney-client relationship. Information shared by clients in connection with legal representation is governed by the California Rules of Professional Conduct and applicable attorney-client privilege.

2. Data We Collect

Website Visitor Data: IP address, domain name, browser type, operating system, pages visited, referring website.

Contact Form and Inquiry Data: First and last name, email address, phone number, company name, description of your immigration matter, and any other information you voluntarily provide.

Client Service Data (existing clients only): USCIS receipt numbers, case status information retrieved via the official USCIS Torch API (OAuth 2.0), immigration form types (e.g., I-130, H-1B, L-1, TN), petitioner and beneficiary names, priority dates, notice dates, and case status history.

Text Messaging Data: Mobile phone number (if you opt in), and consent records for text message communications.

We do not collect geolocation data, financial account information, medical information, biometric data, or genetic information through this Website.

3. How We Use Your Data

We use data to respond to inquiries and provide legal services; monitor and report USCIS case statuses on behalf of existing clients; send nightly automated case status reports to authorized firm personnel; send appointment reminders and case updates; improve this Website; comply with legal and ethical obligations; and detect and prevent fraud. We do not use your data for advertising, behavioral profiling, or any purpose unrelated to legal services.

We share data only with the third parties listed below. Each operates under its own published terms of service and privacy policy, which govern how your data is handled. We share only the minimum data necessary for each specific purpose.

We do not sell, share, rent, or trade your personal information with any third party for marketing or commercial purposes. De-identified, anonymized, or pseudonymized data will not be shared with any third party without your active, informed consent.

5. No Sale of Data

We do not sell, rent, or provide your personal information or immigration case data to any outside party for commercial purposes or monetary consideration of any kind. This applies to identified, de-identified, anonymized, and pseudonymized data alike.

6. Your Data Rights and Choices

Access: Request a copy of personal information we hold about you. Correction: Request correction of inaccurate information. Deletion: Request permanent deletion at any time (see Section 11). Opt-Out of SMS: Reply STOP to any text message.

Data Sharing Choices: You may request that we limit sharing to only what is strictly necessary. Note that some sharing (such as with USCIS for case status checks) is inherent to the services and cannot be limited without affecting service delivery.

Risks and Benefits of Data Sharing: Sharing USCIS receipt numbers with the Torch API enables automated nightly case monitoring. Only the receipt number assigned by USCIS is transmitted — no client names or personal identifiers.

Impact on Others: USCIS cases often involve both a petitioner and beneficiary. Case status data may reflect information about both parties, and we handle all such data with equal care.

7. Cookies

This Website does not use cookies. We do not place any cookies on your device, track your browsing behavior across sites, or use any cookie-based analytics or advertising tools.

8. Security and Data Breach Notification

We implement industry-standard safeguards including HTTPS/TLS encryption, OAuth 2.0 authentication for all USCIS API calls, environment-variable isolation of credentials, and access limited to authorized personnel only. In the event of a data breach affecting your personal information, we will notify you within the timeframe required by California law (generally 72 hours of discovery) and provide instructions for protective steps. Notifications will be sent to your email address on file.

When data reaches the end of its retention period, it is permanently and securely deleted from our systems and backups within 30 days.

10. Account Closure

We will confirm receipt within 5 business days and complete closure and deletion within 30 calendar days, except for data required by law.

11. Data Deletion Requests

You have the right to request permanent deletion of your personal data at any time.

We will confirm receipt within 5 business days, complete deletion within 30 calendar days, and notify you in writing when done. Data required by law will be identified and explained; all other data will be permanently deleted.

12. Transfer of Ownership or Business

If the Firm is sold, merged, or dissolved, you will be notified by email no later than 30 days before any transfer. The acquiring entity must comply with this Policy or provide a materially equivalent one. You will have the option to have your data transferred, receive a copy, or request permanent deletion before the transfer. We will obtain your active consent before transferring data to any entity with materially different privacy practices.

13. California Consumer Privacy Act (CCPA)

California residents have the right to know, delete, correct, and opt out of sale (we do not sell data), and the right to non-discrimination for exercising CCPA rights. To exercise your rights, contact us using Section 1 information. We will verify your identity and respond within 45 days as required by law.

14. Text Message (SMS) Communications

By checking the SMS consent box on our contact form, you consent to receive text messages from Parikh & Prasad, PC. Message frequency varies. Standard rates may apply. Reply STOP to opt out, HELP for assistance. SMS opt-in data and consent will not be shared with any third parties for marketing. Our SMS program complies with TCPA and FCC regulations.

15. Children’s Privacy

This Website is not directed at children under 13. We do not knowingly collect information from children under 13. Contact info@path2immigration.com immediately if you believe a child has submitted information and we will delete it.

17. Changes to This Policy

When we make material changes, we will post the updated Policy with a new effective date, send a plain-language summary of changes to your email on file, and obtain your active consent before applying material changes to already-collected data.
